GettaShower Terms of Service (EU/EEA)

These Terms of Service ("Terms") govern access to and use of the GettaShower platform, including the mobile app, host features, and related support/admin processes. Experimentar AB (Org. nr: 559578-3274) is the legal entity operating under the brand "GettaShower".
These Terms are drafted for a Europe-focused operation and should be validated by qualified legal counsel before production publication.
1. Contracting Entity
Your contract is with Experimentar AB (Org. nr: 559578-3274), operating under the brand "GettaShower" ("GettaShower", "we", "us").

2. Service Description
GettaShower is a platform that connects guests with shower facilities offered by independent hosts.
Core service features may include:
- Discovering facilities and availability
- Starting and ending paid sessions
- Payment setup and charging through integrated payment providers
- Ratings/reviews
- Refund, complaint, and safety reporting flows
- Host onboarding and compliance verification workflows
GettaShower is an intermediary platform. Unless expressly stated otherwise, physical facilities are operated by hosts, not by GettaShower. Any references in marketing or product materials to quality, verification, standards, trust, hygiene, or safety are service-level positioning statements and do not create an independent legal warranty by GettaShower over third-party premises.
3. Acceptance and Eligibility
By creating an account or using the service, you agree to these Terms and the Privacy Policy.
You must:
- Be at least 18 years old
- Have legal capacity to enter a contract
- Provide accurate and current information
If you use the platform on behalf of a company (host side), you represent that you are authorized to bind that entity.
4. Account and Security
You are responsible for:
- Maintaining account credential confidentiality
- All activity under your account
- Promptly informing us of unauthorized use
We may suspend, restrict, or terminate accounts where required for security, fraud prevention, legal compliance, or Terms violations.
5. Payments, Charges, Refunds, and Payouts
5.1 Guest payments
- Card setup and payment processing are handled through third-party payment partners.
- Session charging logic may include pre-authorization, capture, cancellation, and reconciliation flows.
- Final charge amounts are based on platform pricing logic and facility configuration shown in the app.
5.2 Refunds
- Refund requests are case-based and subject to review.
- Approved refunds are executed through payment provider APIs.
- Refund outcomes may be full or partial depending on case facts and payment status.
5.3 Host payouts
- Host payouts may be delayed/on-hold for risk, dispute, or policy windows.
- Payout reversals may occur where refunds/disputes require correcting previous host transfers.
- Hosts are responsible for correct tax/VAT treatment of their business receipts.
5.4 EU consumer cancellation / right of withdrawal
Where EU consumer law grants a 14-day withdrawal period for digital services, you expressly request immediate performance when you start a shower session in the app (for example, by confirming and starting after scanning the QR). You acknowledge that once the service has begun, you may lose the right of withdrawal for that specific service to the extent permitted by applicable law.
6. User Conduct Rules
You must not:
- Use the platform unlawfully or for abusive/fraudulent activity
- Circumvent access controls or attempt unauthorized system access
- Upload illegal, infringing, or malicious content
- Harass, threaten, or endanger other users, hosts, or staff
- Misrepresent identity, ownership, or legal authority
We may remove content and take account action when violations are detected.
7. Content and Evidence
Users/hosts may submit text, reviews, reports, and evidence files.
By submitting content, you confirm:
- You have rights to share it
- It is accurate to the best of your knowledge
- It does not violate law or third-party rights
You grant GettaShower a non-exclusive license to process and use submitted content as needed to operate, secure, and enforce the service.
8. Safety, Complaints, and Moderation
GettaShower may investigate complaints, reports, and safety issues and may:
- Request additional evidence
- Restrict account capabilities
- Resolve/dismiss case reports
- Preserve data under legal hold where necessary
Moderation and compliance decisions are made under internal policies and applicable law.
9. Intellectual Property
All platform software, branding, and service content (except user-submitted content) are owned by GettaShower or licensors and protected by law.
No right is granted to copy, reverse engineer, scrape, or commercially exploit the platform beyond permitted use.
10. Disclaimer and Liability Framework
To the maximum extent permitted by mandatory law:
- The platform is provided "as is" and "as available".
- We do not guarantee uninterrupted or error-free operation.
- We are not responsible for the independent acts/omissions of host-operated facilities.
Nothing in these Terms excludes liability that cannot be excluded by law (including mandatory consumer protections, fraud, or willful misconduct where applicable).
11. Limitation of Liability
Subject to mandatory law, GettaShower's aggregate liability arising out of or related to the service is limited to the greater of:
- Amounts paid by you to GettaShower in the 12 months before the event giving rise to liability, or
- EUR 100
Indirect, incidental, special, punitive, and consequential damages are excluded to the extent legally permitted.
12. Indemnity
Where legally permitted, you agree to indemnify GettaShower for losses arising from your unlawful acts, Terms breaches, or rights violations.
13. Suspension and Termination
We may suspend or terminate access where needed for legal compliance, safety, fraud risk, or material Terms breach.
You may stop using the service at any time. Some legal provisions survive termination (for example payment/reconciliation, audit, liability, dispute clauses).
14. Governing Law and Disputes
These Terms are governed by the laws of Sweden, without prejudice to mandatory consumer law rights in your country of residence.
Competent courts: courts of Sweden, unless mandatory law provides otherwise.
EU consumers may also use available EU online dispute resolution channels where applicable.
15. Changes to the Terms
We may update these Terms. Material updates are communicated through appropriate channels. Continued use after the effective date constitutes acceptance where legally valid.

Part A - Guest Terms (Specific)
The clauses below apply specifically to guest users booking and using facilities.
A1. Facility access and behavior
- Guests must respect host house rules and lawful instructions.
- Guests are responsible for their own health suitability and personal belongings.
- Misuse, vandalism, harassment, or unsafe conduct may lead to immediate account restrictions.
A2. Session usage
- Guests must start/end sessions correctly in the app.
- Charges are calculated from recorded session events and pricing parameters.
- If technical issues occur, support resolution may require logs and evidence review.
A3. Reviews and reports
- Reviews must reflect genuine experience and comply with law.
- False or abusive reporting is prohibited and may trigger sanctions.
Part B - Host Terms (Specific)
The clauses below apply to hosts (legal entities and authorized representatives).
B1. Host legal status and authority
Hosts represent and warrant that they:
- Are legally established and authorized to operate listed facilities
- Hold required permits/licenses and comply with health/safety/consumer rules
- Provide accurate and up-to-date company/compliance information
B2. Host compliance and onboarding
Hosts may be required to complete:
- KYB and compliance document submissions
- VAT/business verification checks
- Declarations confirming legal responsibility and operational compliance
- Proof of active commercial liability insurance, as requested by GettaShower
Hosts must maintain, at their own cost, active commercial general liability (or equivalent business liability) insurance that is adequate for shower/public hygiene operations and related customer injury/property risks under applicable law. GettaShower may request certificates, policy summaries, renewal proof, and insurer details at any time. Failure to provide valid evidence may result in listing suspension, payout hold, or account restriction.
GettaShower may suspend listing/payout capabilities if compliance cannot be verified.
B3. Facility operations
Hosts are solely responsible for:
- Facility condition, hygiene, staffing, and service quality
- Lawful operation of premises and customer safety
- Accuracy of listing details (address, schedule, pricing, amenities)
GettaShower does not assume direct operator liability for host-managed premises solely by offering the digital marketplace, except where mandatory law provides otherwise.
B4. Host financial terms
- Platform fee and payout structures are defined by GettaShower policy and may evolve with notice.
- Payout timing may include hold periods for risk, chargeback, complaint, or refund handling.
- Refund-related reversals may reduce or reverse transferred host amounts where applicable.
- Chargeback-related and card-network dispute costs (including processing fees, scheme assessments, penalties, and evidence handling costs) attributable to host service quality, host conduct, or host non-compliance may be set off and deducted from current or future host payouts, to the extent permitted by law.
B5. Host liability and indemnity
Hosts remain primarily responsible for claims arising from host operations, except to the extent mandatory law provides otherwise.
Hosts agree to indemnify GettaShower against losses resulting from host non-compliance, misrepresentation, or unlawful operation, as legally permitted.
